Introduction The New York State Insurance Department released circular letter No. 22 on September 30, 2009. This circular letter reiterates the mandate for all insurers to allow plan sponsors the option to offer coverage to qualifying young adults through age 29 as dependents under family coverage. WHAT THIS MEANS TO YOU AS AN EMPLOYER? You may request the option to increase the maximum age until which a young adult is considered a “dependent” under the policy or contract. Chapter 240 of the Laws of 2009 took effect September 1, 2009, and applies to all contracts issued, renewed, modified, altered or amended on or after such date. Please note, you have the option to offer this coverage but you need not request this option. It is not mandated that plan sponsors offer this coverage. WHAT SHOULD I DO NEXT?
